By accessing or using any Reflektar Inc. website, platform, application, or service (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our Services.

These Terms apply to all users of the Services, including browsers, registered accounts, and contributors of content or data. Reflektar Inc. reserves the right to update these Terms at any time, and your continued use constitutes acceptance of any changes.

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any way that violates applicable laws or regulations. • Upload or transmit unlawful, harmful, or unauthorized data. • Attempt to gain unauthorized access to any part of our platform or related systems. • Reverse engineer, decompile, or disassemble any part of the Services. • Use automated tools (bots, scrapers, etc.) to access or extract data from the platform without written permission. • Interfere with or disrupt the integrity or performance of the Services.

If you create an account with Reflektar, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Reflektar reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for extended periods, without prior notice.

All content, software, technology, trademarks, logos, and intellectual property available through the Services are the exclusive property of Reflektar Inc. or its licensors. Nothing in these Terms grants you any right to use Reflektar's name, logo, or branding.

Client-submitted data (including LiDAR point clouds, survey files, and project data) remains the intellectual property of the client. By submitting data to our platform, you grant Reflektar a limited license to process and analyze that data solely for the purpose of delivering the requested Services.

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Reflektar Inc. does not warrant that the Services will be uninterrupted, error-free, or completely secure.

To the fullest extent permitted by law, Reflektar disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Reflektar Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Services.

In no event shall Reflektar's total liability to you exceed the amounts paid by you to Reflektar for the Services in the twelve (12) months preceding the claim.

Our platform may contain links to third-party websites or services that are not owned or controlled by Reflektar Inc. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

We strongly advise you to read the terms and privacy policies of any third-party sites you visit via links from our Services.

Reflektar Inc. reserves the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

We may also update these Terms from time to time. The most current version will always be available on our website. Your continued use of the Services after changes are posted constitutes your acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions.

Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Alberta, Canada. You waive any objection to the exercise of jurisdiction over you by such courts.
